Services Description

Moxart provides digital services including but not limited to:

All services are provided subject to project-specific agreements, quotes, and contracts that may contain additional terms and conditions.

Project Agreements and Quotes

When you engage Moxart for a project:

• •We will provide a detailed quote outlining scope, timeline, and pricing
• •All quotes are valid for 30 days from the date of issue
• •A formal project agreement or contract will be required before work begins
• •Project terms, including scope changes, will be documented and agreed upon in writing

Payment Terms

Payment terms for our services are as follows:

• •A 50% deposit is typically required to begin work, with the remaining 50% due upon project completion
• •For larger projects, milestone-based payment schedules may be arranged
• •All prices are quoted in GBP (£) for UK clients and USD ($) for US clients, unless otherwise specified
• •Payment is due within 7 days of invoice date unless otherwise agreed
• •Late payments may incur interest charges and may result in suspension of services

Intellectual Property Rights

Client Content: You retain all rights to content, materials, and intellectual property you provide to us. By providing such materials, you grant us a license to use them solely for the purpose of completing your project.

Deliverables: Upon full payment, you will receive ownership of the final deliverables as specified in your project agreement. This includes source code, design files, and all project assets created specifically for your project.

Moxart IP: We retain rights to our proprietary tools, frameworks, templates, and methodologies. Pre-existing code libraries and third-party components remain subject to their respective licenses.

Project Scope and Revisions

Our standard service includes:

• •One round of revisions within 7 days after delivery. This includes minor adjustments and fixes to the delivered work.
• •Project delivery as specified in the project agreement

New features or changes outside the agreed scope will be quoted separately and require written approval before implementation.

Timelines and Delivery

We typically deliver a clickable prototype within 48–72 hours, and final delivery within 7–21 days depending on complexity and client responsiveness. However:

• •Project timelines depend on client responsiveness and timely provision of required materials
• •Delays in client feedback or approvals may extend project timelines
• •We will communicate any potential delays as soon as they become apparent
• •Complex projects or scope changes may require timeline adjustments

Client Responsibilities

To ensure successful project delivery, clients are responsible for:

• •Providing accurate project requirements and specifications
• •Supplying all necessary content, images, logos, and materials in a timely manner
• •Responding to requests for feedback and approvals within agreed timeframes
• •Ensuring they have rights to all materials provided to us
• •Making timely payments as agreed

Warranties and Disclaimers

Service Warranty: We warrant that our services will be performed in a professional and workmanlike manner, consistent with industry standards. We will correct any defects in our work that are reported within 30 days of project completion.

No Guarantees: While we strive for excellence, we cannot guarantee specific business outcomes, search engine rankings, or performance metrics. Results depend on numerous factors beyond our control.

Third-Party Services: We are not responsible for the availability, performance, or terms of third-party services, platforms, or APIs that may be integrated into your project.

Limitation of Liability

To the maximum extent permitted by law, Moxart's total liability for any claims arising from or related to our services shall not exceed the total amount paid by the client for the specific project in question. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Cancellation and Refunds

Client Cancellation: If you cancel a project after work has begun, you will be charged for work completed up to the cancellation date. Deposits are non-refundable once work has commenced.

Moxart Cancellation: We reserve the right to cancel or refuse service for any reason, including but not limited to inappropriate content, illegal activities, or non-payment. In such cases, we will refund any unearned portion of payments.

Confidentiality

We respect the confidentiality of your business information and project details. We will not disclose confidential information to third parties without your consent, except as required by law or as necessary to perform our services. We may use completed projects in our portfolio with your permission.

Governing Law

These Terms shall be governed by and construed in accordance with:

• •The laws of the United Kingdom, where the Client is located in the UK.
• •The laws of India for all Clients located outside the United Kingdom.

In all cases, disputes shall be subject to jurisdiction as per applicable regional laws.

Changes to Terms
